Their site is designed to assist the retail leasing industry in NSW to prevent and resolve tenancy disputes. It also provides useful links to the major retail industry associations.
See the FAQ about retail tenancies deep in their infokit. Many of these answers have been provided by industry advisors and organisations.
However, it is a pity that the FAQ information is wrapped in a large Flash file because you will need an up-to-date Flash viewer to see it and it could take some time to download depending on the speed of your internet connection.
retail.nsw.gov.au/infokit
LUCHETTI & Co ..Solicitors.. (Keep your own case file)
(f) Think carefully about what your lawyer has said to you and make sure that the advice suits your circumstances.
(g) Trust your lawyer and follow their instructions.

Also let your lawyer know if the circumstances of your matter change, or if your contact details change.
Understand the fees and costs and keep in contact.
Do not hide details for fear of embarrassment it is important to let the lawyer know all the details upfront in order to give you accurate advice. Information on house prices suggested that average nationwide prices had fallen over the three months to July. Other indicators of activity in the secondary housing market had remained subdued."
Later on they say..
"investment spending had been strong and surveys of investment intentions indicated it would rise further in the year ahead. Overall, the picture seemed to be one of weak consumption and strong investment, but with aggregate growth of demand slowing. Members noted also that there was still considerable stimulus to domestic activity coming from the external sector. The run-up in commodity prices had increased Australia’s terms of trade, adding substantially to national income and capacity to spend. Looking ahead, however, the world economy was slowing and it was therefore unlikely that the external stimulus to Australia would be as strong in the year ahead."
[more..]
LUCHETTI & Co ..Solicitors.. Issues to consider include:
A. whether the person is able to deal in a fairly capable way with the ordinary regular dealings in life so as to provide for their own welfare and anyone dependent on them,
B. whether they understand their assets and outgoing expenses, and,
C. whether they can manage their money to provide food, clothing, medicine and other necessities.
Second, if they can’t manage their affairs, is there a risk that they may be disadvantaged or harmed, or their money or property wasted or lost?
In addressing capacity it is important to avoid discrimination. Don’t assume a person lacks capacity based on age, appearance, disability, behaviour or any other condition or characteristic.
Before concluding lack of capacity, ensure that everything possible has been done to support the person to make a decision.
See the full article in the PDF file
../2008/news2008_3.pdf
LUCHETTI & Co ..Solicitors.. So if your body corporate is SP9999 or less you have another year before you have to get started.
What it involves is that owner corporations are required to work out their capital expenditure needs for the next 10-years.
Owners corporations are expected to use either their own resources or outside experts to devise these plans.
When you are required to commence this planning is determined by your strata number:

SP 30,000 and over were to have been organised by July 2007

SP 10,000 – 29,999 by 1 July 2008

SP 1 – 9,999 by 1 July 2009.

By the second AGM after these dates a plan should be in place. There are three main risks with email:
• sending emails containing blue humour (harassment).
• making a legal contract by email.
• defamation.
In a perfect world you would have a lawyer draw up your email policy. If you are an Executor of an Estate this means that you can expect to be asked questions by the beneficiaries.
Make sure you know these dates (or possible dates): Notice of intended application for probate; Probate; Notice of intended distribution.
Will there be an interim distribution? There often is so, when will it be likely to happen and when can the final distribution be made?
Arrange a progress report from your solicitor along with a copy of the Estate account or Trust statement. Some informal ways of doing this are by making your wishes known to friends, relatives and your doctor, and by writing your wishes down.
There are also formal, legal ways to make sure that your wishes are respected. These are called; enduring guardianship and advanced health care directives or living wills. See us to draw these up for you or see the following links for further information: lawsociety.com.au
It is a Living Thing [luchettilawyers.com.au/itsalivingthing.asp]
LUCHETTI & Co ..Solicitors.. What are you worth?
2. Who do you want to have it next?
3. Who will be your Executor (someone you trust to make that happen)?
4. What can be done to make it easier and/or clearer?
Also think about where can you put your will so that people know where to find it when the time comes (and maybe, not before).
Answer these questions on our will form.
to see if you need to take the next step.
Also have a look at what the Law Society of NSW has to say on this topic:
lawsociety.com.au/page
LUCHETTI & Co ..Solicitors.. He said that rental yields on investment property were recovering. So a tip like this may be welcome.
Make the most of your doctor's appointment by giving the doctor the information in the same format they learnt in medical school.
* Make an up-to-date patient profile for yourself
* Describe your basic reasons for the visit (in one or two sentences)
* Point to the location of your symptoms
* Use adjectives to describe your symptoms
* Rate your symptoms
* Recall the onset and timing of your symptoms
* Describe the setting and your condition when the symptoms occurred
* Explain what makes the pain better or worse
* List other things that happen at the same time
* Talk about your symptoms, not your diagnosis
[more..]
LUCHETTI & Co ..Solicitors..
